25 November 2011: Course on Legal Development in Modern China taught by Dr Yuwen Li

The Chinese legal system has developed rapidly since the end of the 1970s, in parallel with China’s miraculous economic success. Obviously, this generates a growing interest among Western legal practitioners in understanding Chinese law. This course intends to provide insightful knowledge and information on the key features of law-making and law enforcement in post-Mao China and the role of lawyers in building the rule of law in transitional society.

Four topics will be addressed particularly:
(1) Chinese legal tradition and the path of modernizing law;
(2) Legal development in the past thirty years;
(3) Reforming the judicial system;
(4) Emergence of the legal profession

6 - 14 November: ECLC receives delegation of scholars and judges specialized in administrative law and administrative litigation

From 6 November to 14 November 2011, the Erasmus China Law Center (ECLC) received a Chinese delegation consisting of scholars and judges specialized in administrative law and administrative litigation.

During the delegation’s stay in the Netherlands, they held meetings with Dutch judges and experts from the Council of State, the National Ombudsman, courts in Den Haag and Rotterdam, Peace Palace and Loyens & Loeff law firm. The visit to the Netherlands was concluded with an academic meeting with lawyer Hugo Pennarts and Professor L.J.R. Rogier and Professor A.R. Hartmann from ESL. Common issues of concern and newly emerging hot topics which were most controversial in the administrative law and administrative litigation fields were openly discussed and the exchange of ideas and experiences in the Netherlands and China turned out to be inspiring for all participants.

After visiting the Netherlands, the delegation paid a visit to the European Court of Human Rights in Strasbourg. Judge Egbert Myjer received the delegation and addressed the topic of Article 6 of European Convention of Human Rights and its impact on the practice of Dutch administrative law.

The delegation was delighted that they were able to learn so much from such distinguished Dutch experts within such a short period of time and greatly appreciated this thoughtful arrangement of the ECLC.

This delegation’s visit is one of the activities of the project on Improving the Administrative Litigation System in China, which is sponsored by the Dutch Embassy in Beijing and co-implemented by the law school of Wuhan University in China and ESL.

ECLC and Erasmus School of Law welcome 5 new PhD students

In September, Erasmus School of Law warmly welcomed the arrival of five new Chinese PhD candidates from China: Ms. Ma Yun, Ms. Pei Wei, Ms. Xun Xiao and Zhao Xiaoqi from the China University of Politics and Law, Ms. Xin Wen from the National University of Finance and Economics. All of them come from Beijing, the capital of China. These four candidates just received their Master degree in Law in China in July 2011, and they were all very lucky to receive a four year scholarship from the China Scholarship Council (CSC) for conducting research at the ESL. Their research will be supervised by Prof. Edwin Bleichrodt, Prof.  Michael Faure, Prof. Maarten Kroeze,  Prof.  Roel de Lange, and Dr. Yuwen Li.

28 April - 6 mei Studiereis Peking

(for a report in English from Dr Li, please click here). Na maanden voorbereiding was het eind april eindelijk zo ver! Van 28 april tot en met 6 mei is het O.R.D. met studiereis naar Beijing gegaan. Tijdens deze reis werd de groep begeleid door universitair docent mevrouw Yuwen Li. Bij prestigieuze kantoren als Baker& McKenzie, De Brauw Blackstone Westbroek en King & Wood werd de groep professioneel en enthousiast ontvangen.

 

Daarnaast zorgde de Peking Universiteit en de Beijing Arbitration Commission voor een hartelijke en informatieve welkomst. Naast deze formele bezoeken was er ook voldoende tijd om informele activiteiten te ondernemen: de Chinese muur werd getrotseerd en de Verboden Stad bewonderd. Al met al was de reis voor de deelnemers onvergetelijk. Mede dankzij de inzet van mevrouw Yuwen Li en de commissie werd de reis een onvergetelijke ervaring voor alle deelnemers.

8 December - Visit to ICJ and ICTY

On 8 December 2010, the Erasmus China Law Centre organised a visit to the International Court of Justice (ICJ) and the International Tribunal fort the former Yugoslavia (ICTY) for EUR LLM students and PhD candidates from China.

Judge Xue Hanqin gave a lecture on the history of the ICJ and answered questions on international law issues. She also talked about the challenges Chinese students face when they study international law.



At the ICTY, the students observed a session of the tribunal. Then, Judge Liu Daqun invited the group to his office. He talked about his work and experiences at the tribunal. Further, he gave the students advice how to study international law and recommended some books for their study.

6 December 2010 Round Table Professor Lü Zhongmei

On 6 December 2010, Professor Lü Zhongmei, President of Hubei University of Economics, visited the Erasmus School of Law. Professor Lü graduated from the Law School of Peking University in 1984. Previously, she was a professor of environmental law at Wuhan University and served as Vice-President of the Higher People’s Court in Hubei province for several years. Due to her rich experience in judicial practice and academic work, she has become one of the most outstanding legal experts in China. Professor Lü took part in a round-table discussion on China’s court system and the rule of law and shared her insights with lecturers and students of the ESL. She summarized the experiences made during the initial stages of the reform of the judicial system in China. Further, she described the current situation of the court system and several problems in the judicial system that are partly the result of China’s fast economic development and the need to develop the administration and judiciary adequately in all parts of the country.

19 November 2010 Guest lecture Prof Zhu Sanzhu

On Friday 19 November Professor Zhu Sanzhu, professor of Chinese law at the School of Oriental and African Studies, University of London held a guest lecture for an interested group of staff and students on Modern Chinese Law and Institutions Sixty Years on: Reflections on the Western Studies of Contemporary Chinese Law.

Prof Zhu gave an overview of Western scholarship on Chinese law with respect to the development of China’s legal system since the establishment of the People’s Republic of China in 1949.
